However, it is noted that the explosion followed Attorney General Marshall's announcement the previous week that he would not prosecute providers of in vitro fertilization, nor families utilizing their services. This announcement came after Alabama's Supreme Court ruling that classified frozen embryos as children under state law. The ruling was made in response to two wrongful death cases filed by three couples whose frozen embryos were destroyed in an accident at an Alabama fertility clinic.
