
GOP lawmaker urges Merrick Garland to remove Biden from office using 25th Amendment

Claudia Tenney claimed, is urging Attorney General Merrick Garland to invoke the 25th Amendment to remove President Joe Biden from office. Tenney's call comes after special counsel Robert Hur's report stated that while Biden should not be prosecuted for mishandling classified documents, he does suffer from a poor memory.

Expressing her "grave concerns" about Hur’s findings, Tenney criticized the decision not to bring charges against Biden, despite the president "knowingly and willfully" removing, mishandling, and disclosing classified documents over several decades. The report highlighted instances of the president suffering from memory loss and presented "serious risks to national security."
Emphasis on prosecution and ethical application of the law
In a letter to Garland, Tenney emphasized that personalities or public perception should not influence the decision to prosecute individuals. Drawing a comparison to the investigation of former President Donald Trump, Tenney argued that Biden should either face charges or be removed from office, emphasizing the need for ethical and consistent application of the law.
Tenney called upon Garland to initiate proceedings utilizing the 25th Amendment, which provides a mechanism for the vice president and a majority of the Cabinet or an alternative body designated by Congress to transfer power from the president in the event of removal or incapacitation.
President Biden's response
Following Hur's report, Biden vehemently rejected its findings and defended the state of his memory, refuting any wrongdoing.
