The series includes a “mock trial” of Hunter Biden on charges he has not faced, displaying nude photographs and depiction of sexual acts involving Biden, according to the lawsuit.

Violation of New York Law

The lawsuit emphasizes that the dissemination of these intimate images without Biden’s consent is in violation of New York's revenge porn law. It asserts that Fox News published and distributed the images to a wide audience in an effort to humiliate, harass, annoy, and alarm Mr. Biden, as well as tarnish his reputation.

Fox News Responds

In response, a Fox News spokesperson dismissed the lawsuit as “entirely politically motivated” and “devoid of merit” in an official statement. The network also mentioned that, in April 2024, Biden's attorneys had sent them a letter demanding the removal of the program from streaming platforms. The program was subsequently removed as a precautionary measure.

Biden’s Legal Situation

Hunter Biden, last month, was convicted of three felony charges related to the purchase of a revolver in 2018. The charges stemmed from allegations that he lied on a mandatory gun-purchase form by denying illegal drug usage or addiction. He is now a convicted felon.

The lawsuit underscores that the mock trial in the series included unfounded charges of bribery and improper financial dealings with foreign governments. These charges have not been brought against Hunter Biden in reality, as stated in the lawsuit.

As part of the lawsuit, Hunter Biden is seeking compensatory and punitive damages, as well as an order to compel Fox News to remove any copies of the explicit images. It alleges that promotional materials still exist and the program is accessible on certain third-party streaming platforms, despite the removal from Fox's own platforms.
