Deteriorating Conditions in Rafah
The court highlighted that the circumstances in Rafah had worsened since its previous ruling in March. It emphasized that the provisional measures prescribed at that time no longer adequately address the current situation. Moreover, the court found that the evacuation and other measures taken by Israel in Rafah were deemed insufficient.
The ruling further stipulated that Israel must undertake effective measures to ensure unimpeded access to the Gaza Strip for any United Nations-mandated investigative bodies. These bodies are tasked with investigating allegations of genocide, underscoring the severity of the situation in the Gaza enclave.

Referred to as the World Court, the International Court of Justice issues final and unappealable rulings, although it lacks the direct authority to enforce them. South Africa's Involvement
South Africa urged the ICJ to address the Rafah offensive within a broader case initiated in December. This case specifically requested the Court to pronounce on the potential risks of genocide stemming from Israel's broader military campaign in the Gaza Strip. The Court had previously called on Israel to take preventative measures against genocide in the besieged enclave but stopped short of mandating a cease-fire.
Israel has reiterated that its objectives in the Gaza Strip are not aimed at targeting civilians but rather at eliminating the Palestinian militant group Hamas. Official figures indicate that Hamas was responsible for a terror attack in Israel on October 7, claiming over 1,200 lives. The ongoing Israel-Hamas war has resulted in the deaths of more than 35,000 individuals in Gaza, based on reports from Palestinian health authorities.
