Maine Legislature Approves Bill to Protect Health Care Workers Providing Abortion and Gender-Affirming Care
Maine's Democratic-led Legislature passed a bill safeguarding health care workers providing abortion and gender-affirming care from out-of-state legal action.
On Friday, the Democratic-controlled Maine Legislature approved a bill aimed at safeguarding health care workers who offer abortion and gender-affirming care from legal action in other states. If signed by Democratic Gov. Janet Mills, Maine would become one of over a dozen states that provide protection to medical providers and others from out-of-state investigations concerning abortions.
Divided Votes in the Legislature
The Maine Senate approved the bill with a 21-13 vote, following a 76-67 vote in the House the day before. Notably, the bill faced strong opposition from Republican lawmakers.
Legal Threats from Other States
The decision came after attorneys general from 16 states, including Tennessee, issued warnings of legal action against Maine if it proceeded with implementing a shield law to prevent out-of-state repercussions for those offering abortions and gender transition surgeries for children.
Maine Attorney General Aaron Frey dismissed these accusations as "meritless," emphasizing the necessity of shield laws due to attempts by other states to penalize lawful behavior extending beyond their borders. He stressed the importance of harmony and restraint in shaping health care policy across states.
Debate and Censure
The bill sparked intense debate in Maine, leading to the censure of two lawmakers in the House after one of them made controversial remarks linking the legislation to divine retribution in the form of mass shootings and recent storms. Both lawmakers were required to issue formal apologies on the House floor to regain their speaking and voting privileges.
Support for the Legislation
Lisa Margulies, representing Planned Parenthood Maine Action Fund, expressed gratitude towards the lawmakers who stood up against threats, political rhetoric, and misinformation to safeguard safe and legal medical care in Maine.
