Michigan Woman Receives Life Without Parole for Death of Disabled Son

A 44-year-old woman from Norton Shores, Michigan, named Shanda Vander Ark was sentenced to life in prison without the possibility of parole, as well as an additional 50 to 100 years for first-degree child abuse, for the starvation death of her disabled 15-year-old son, Timothy Ferguson. The tragic incident occurred on July 6, 2022.

Judge's Reaction and Prosecution

During the sentencing, Judge Matthew Kacel expressed his disbelief at the horrific nature of the crime, referring to the intentional and systematic torture inflicted upon the victim, Timothy Ferguson, who weighed only 69 pounds at the time of his death. Prosecutors stated that Timothy had some mental disabilities.

Defendant's Portrayal and Testimonies

Vander Ark, who was observed wearing orange jail attire, chose not to speak at the sentencing. Her attorney, Fred Johnson, portrayed her as a survivor who had overcome challenging circumstances as a single mother putting herself through school. Johnson emphasized that they were not dealing with evil, but with sickness.

The victim's brother, Nolan Ferguson, emotionally testified that if he couldn't have his brother back, his mother should not have her freedom. Another brother of the victim, Paul Ferguson, has also been implicated in the case for first-degree child abuse and pleaded guilty in December 2023. He is expected to be sentenced in late February.
