
Special counsel seeks to dismiss charges against President-elect Trump
Special counsel Jack Smith seeks to dismiss felony charges against Trump related to 2020 election overturn efforts and the Jan. 6 Capitol attack.

Special Counsel Jack Smith has taken significant steps in the legal battle against President-elect Donald Trump. In a recent motion, Smith has requested that all four felony charges against Trump related to his alleged attempts to overturn the 2020 presidential election in the lead-up to the infamous January 6 attack on the U.S. Capitol be dropped. The charges, which include conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights, were first brought against Trump in August 2023.
Charges Filed Against Trump
The initial indictment against Trump marked a historic moment in American history, as it was the first time a president was accused of attempting to illegally maintain power. However, the case was subsequently put on hold for several months as Trump's legal team argued that he could not be prosecuted. Now, the prospect of dropping the charges represents a momentous shift in the legal landscape, comparable to the forced resignation of President Nixon amid allegations of criminal conduct fifty years ago.
In a filing on Monday, Smith's office stated that while the government’s position on the merit of the defendant's prosecution has not changed, the circumstances have. The filing seeks to dismiss the charges ahead of Trump's inauguration, in line with the Justice Department’s longstanding position that it cannot charge a sitting president.
Implications of the Dismissal
Smith emphasized that this prohibition does not depend on the severity of the charges, the strength of the government's proof, or the merits of the prosecution. The special counsel's office intends to resign before Trump takes office, as required by special counsel regulations. This resignation will be accompanied by a report to the attorney general explaining their charging decisions.
Despite the serious charges against him, Trump, through spokesman Steven Cheung, hailed the decision by the Department of Justice as a victory for the rule of law. Cheung expressed that the American people, along with Trump, desire an immediate end to what they perceive as the political weaponization of the justice system.
The 2020 Election Claims
Throughout the legal proceedings, Trump's claims regarding the 2020 election results have been a focal point. While he has never publicly acknowledged that his election claims were false, he has consistently maintained his plea of not guilty in the case. This refusal to concede has been echoed by some defendants from January 6, who later expressed regret for being "gullible" enough to fall for Trump's falsehoods.
