Biden Administration's Appeal
The Biden administration had presented the case, United States v. Skrmetti, urging the justices to consider the issue. The administration's argument is that the law, which restricts treatment for gender dysphoria in minors, is explicitly based on sex and discriminates against transgender individuals.
The government's petition to the court, submitted by Solicitor General Elizabeth B. Prelogar, emphasizes the disparity in the law. It highlights that the measure prohibits transgender medical care while allowing the same treatments for other purposes.
